General Terms and Conditions All visas are the responsibility of the tour participants. Sun and Fun Tours will not be held liable in any issues regarding passports or visas. All travelers assume complete and full responsibility for, and hereby releases the agent from, any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security and security conditions of such destinations, during the length of the proposed travel. For tours requiring visas for U.S. citizens, detailed visa information can be accessed via our website. You are responsible for obtaining all visas and entry documents, and for meeting all health and other requirements and any documents required by laws, regulations, orders and/or requirements of countries visited. Non-U.S. citizens must consult with the appropriate consulates to determine if any visas are needed. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip.
A non-refundable deposit of $250 per tour and person is required for us to reserve space for you. Final payment is due 45 days prior to commencement of services. If we do not receive final payment by this date, we reserve the right to cancel the reservation. Tour prices stated are per person and based on double occupancy. Departure Taxes, surcharges, visa fees and government fees are not part of the tour price and will be billed as a separate item on your invoice. In the case of billing errors, we reserve the right to re-invoice with correct pricing.
If you must cancel your trip, you must do so in writing. Cancellation refunds will be calculated as of the date we receive your written cancellation. If the cancellation is received in writing by Sun & Fun Tours more than 45 days prior to commencement of services, your deposit will be retained and you will be charged a $100 cancellation fee. This low fee reflects only our costs of administering a reservation, and is not intended to be punitive in any way. We realize the majority of those who cancel their reservations do so out of necessity.

For cancellations 45 days after the commencement of services, the following per person cancellation fees apply:
Cancellation charges also apply to additional services, including accommodations and optional excursions, reserved prior to and after the tour.

If flight changes, including flight cancellations, are requested, revision fees or airline cancellation charges will apply. If an air-inclusive tour is canceled after air tickets have been issued, refund will be processed after the air tickets are returned to Sun & Fun Tours.
Sun and fun Tours reserves the right to cancel or reschedule any tour departure. If cancellation is made prior to departure of the tour, our only responsibility will be to refund to the passenger the amount we have received for the tour reservation. We will try to re-book the same tour with a different departure date. Where Sun and fun Tours has confirmed flights, we will try to confirm air seats for the selected new dates, subject to availability. We cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through Sun and Fun Tours. An administrative charge of $50 per transaction will be charged for any alteration or revision made to a reservation in addition to any cancellation penalties or applicable fees imposed by airlines, hotel, trains, or ferries. A change of traveler name, tour date or tour itinerary within 45 days of commencement of services will be treated as a cancellation and new reservation; standard cancellation fees apply. All changes are subject to availability and cannot be guaranteed. Every effort has been made to produce pricing information accurately. We reserve the right to correct errors.
Air Arrangements

To provide you with the lowest possible airfares, Sun & Fun Tours takes advantage of special promotional fares. These fares can be quite restrictive and carry cancellation charges imposed by the airlines ranging from 25% to 100%. Therefore, any penalties resulting from flight changes at your request after flights are ticketed will be your responsibility. If you cancel your trip after receiving your tickets, you must return your tickets to Sun & Fun Tours before your refund (if applicable) is processed.

If you make your own domestic flight arrangements, Sun & Fun Tours will not be responsible for any loss resulting from cancellations or changes in international gateways or travel dates. We recommend that you do not purchase tickets with high penalty charges for changes. If you make your own domestic flight arrangements and you miss your international flight for any reason, we can assist with alternate flight arrangements; however, you are responsible for the cost of an alternate flight to your destination, as well as any other expenses incurred prior to joining up with your tour group.

Air routings are subject to availability. Routings cannot be guaranteed, and are subject to change at any time. Sun & Fun Tours is not responsible if an airline cancels or delays a flight. If that occurs, you should work with the airline to ensure you arrive at your destination. We will not provide any refund for portions of trips missed due to cancelled or delayed flights. If an air schedule requires an overnight stay in a gateway city, we can assist with hotel reservations; however, if a flight requires a layover, overnights are at your expense. Most programs offer a limited number of single rooms, subject to availability and hotel space. Please see single supplement charge for costs. If you pay for single occupancy but share during your program, contact Sun & Fun Tours in writing upon your return to receive the appropriate refund.
If you are on a program where sharing is possible and you would like to share a twin-bedded room with another single traveler of the same gender, we will do our best to match you with a roommate. Singles who wish to share with another guest should request this at the time of booking and their reservation will identify them as a “single-share-if- possible” basis. The single price is charged initially: however, if at departure we have another person to “share”, the difference between the single price and the per person twin price will be refunded. “Shares” can not be guaranteed.
For the benefit of everyone on your vacation, Sun and Fun tours has the right to accept or reject any person as a tour participant and to remove from the tour any participant whose conduct is deemed incompatible with the interests of the other participants.
You must report any disability requiring special attention to Sun and Fun Tours at the time the reservation is made. We will make reasonable attempts to accommodate the special needs of disabled travelers, but we are not responsible in the event we are unable to do so, nor are we responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. Most transportation services are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a tour member for walking, dining, getting on and off motor coaches and other transportation vehicles, or other personal needs. A qualified companion must be accompany travelers who need such assistance.
Travelers who are less than 18 years old on the tour departure date must be accompanied by an adult. We do not accept children who are less than eight years old.
Smoking is not allowed inside hotel room, aboard transportations, nor flights throughout the tour.
All tour prices are based on rates (including foreign exchange rates) known at the time of printing of brochures and publishing of the web site. Prices are subject to increase without notice if such rates change prior to departure. The current price will be confirmed at the time of reservation. However, once Sun & Fun Tours has received your deposit for any tour departing in 2003, the land price is guaranteed, and any subsequent land cost increases are at our expense, not including surcharges and any government tax increases. Airfares included as part of air-inclusive tour prices are guaranteed when we receive full payment. Tour prices are per person, based on double occupancy. Single room supplements and triple room reductions are listed where applicable.
The accommodations are in the 5 & 4 star category with a selected few in the 3 start category. However, if a change becomes necessary for any reason, the accommodations substituted will be equivalent in standard to those shown. Every effort is made to reserve only twin-bedded rooms. It may occasionally happen that an accommodation provides some double-bedded rooms instead. These rooms will be allocated to couples.
Please note that accommodation check-in times vary worldwide. In exceptional cases where private bath or single rooms as reserved by us are not available, refunds will be made by the tour director or local host. Claims made in this respect cannot be accepted after your tour.
Portage for one suitcase on tour is included in the tour price. Due to limited coach capacity, this single bag should have dimensions not exceeding 30"x18"x10" and weight not exceeding 60 lbs (27 kg). A charge of US$3 per traveling day will be collected by the tour director if a second piece of baggage is carried, or if the suitcase exceeds the established weight and/or dimensions. Air carriers may also impose fees if weight or size limits on checked or carry-on luggage are exceeded.

Wheeled carry-on cases are not suitable as hand luggage on motor coaches.

No responsibility is accepted for loss of or damage to baggage or any of the tour participant's belongings. Baggage Insurance is recommended. Travel documents, including any air tickets, are sent via regular ground delivery two weeks prior to tour departure, providing full payment has been received. A $15 charge per reservation is added for documents requested in advance or for two-day delivery in the continental USA. Please indicate at the time of reservation whether you prefer regular ground delivery or two-day delivery. (Two-day delivery is required for reservations made within 45 days of departure.)
Federal Inspection Fees for U.S. Customs and Immigration; International Air Transportation Tax; agricultural tax; any other taxes; security fee; airport taxes and fees; passports; visas and vaccinations; tips to your tour director, drivers, and in some cases, local city guides; gratuities on ferries; laundry; telephone; mini bar; alcohol, beverages and food not on the regular menu (these extra items will be billed to you before leaving the hotel or restaurant); optional excursions; portage at airports; travel protection; excess baggage fees; all other items of a personal nature.
Please note that any request for refunds is subject to the terms and conditions stated on our website. No refunds can be made for used services of less than 48 consecutive hours, for unused transportation where group activity tickets are involved, or for voluntary modifications by the tour participant.
If after returning from the tour, you wish to inquire about any tour services provided, please ensure that all correspondence relating to those services is received by Sun & Fun Tours within 60 days after the tour completion date. This will enable us to make a timely investigation.
During local and national holidays, certain facilities such as museums and restaurants, sightseeing tours and shopping may be limited or not available. Alternatives will be offered whenever possible.
Please be aware that during your participation in tours operated by Sun & Fun Tours certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. We will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Sun & Fun Tours will use its best efforts to ensure that adequate measures are taken.
The responsibility of Sun & Fun Tours (referred to as “the Company” from here on) and its affiliated companies is strictly limited. As a tour operator, the Company, promotes, and sells tour programs consisting of certain travel services, including surface, air, and water transportation, sightseeing excursions, and cruise/hotel accommodations that the Company purchases or reserves from various suppliers (collectively, “Suppliers”). The Company does not own or operate any of these Suppliers. The Suppliers providing travel services for the Companies tour programs are independent contractors, and are not agents or employees of the Company. As such, the Company is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. Some tours include visits to shops and merchants. The Company is not responsible for any purchases you make during your trip, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither the Company nor any representative of the Company shall be liable.
Without limitation, the Company is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from—but not limited to—acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes of other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the direct control of the Company.

To the extent that the Company is involved in booking air and/or cruise transportation for you, the Company acts as your agent and not as an agent of the air carrier and/or cruise line. For all other purposes, the Company does not act as an agent for any party whatsoever.

The Company reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in airfares, cruise fares, currency fluctuations, park fee increases, taxes, or fuel surcharges. The Company reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice, in which event your sole remedy shall be a prorated refund for any unused portion of the trip. Hotels and other accommodations are subject to change.

If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of the Company, the Company will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers and any resulting saving will be refunded by the Company to tour participants.

The tour participant agrees that neither the Company nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing tour services, or any insurer or insurance administrator of the Travel Protection Plan, or of any other person.
Legal proceedings against the Company may be instituted only in a state or federal court within the State of California, and any claim involved in such proceedings shall be decided in accordance with the laws of the State of California. Any legal proceedings against the Company must be commenced within one year following the date of tour completion. Neither the Company nor any affiliate shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages.

No person, other than an authorized representative of the Company by a document in writing, is authorized to vary, add, or waive any term or condition in this web site, including any term or condition set forth in the preceding provisions. None of the Content shall be construed as an offer for the sale or provision of any services, goods, or products of Sun & Fun Tours or any other entity. All Content contained in this Site is provided for informational purposes only. All tour itineraries, prices, dates, hotels, departures, destinations, and availability of the foregoing may be modified at any time by Sun & Fun Tours without notice.

The Content is provided "AS IS," without any implied or expressed warranty of any kind including, but not limited to, warranties of merchantability, fitness for a particular purpose or use, and non-infringement intellectual property. Sun & Fun Tours does not make any warranties as to the accuracy or completeness of the content. The performance of these Terms and Conditions shall be governed by the internal laws of the State of California, United States of America, without regard to any principles of conflicts of law. All legal proceedings arising out of or in connection with this Site shall be brought solely in the State of California. You expressly submit to the exclusive jurisdiction of said courts. You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition which may require professional attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, Sun and Fun Tours may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.

If you are so challenged, you must bring and be responsible for all necessary items related to your condition. If any such condition arises after the trip is booked, you must advise us in writing immediately. Failure to advise us shall release Sun & Fun Tours and all professional personnel from any liability related to such condition or its treatment.

We cannot accommodate women past their sixth month of pregnancy. If you require a wheelchair, you must provide your own small, collapsible wheelchair. Certain features, and certain trips, are not wheelchair-accessible. We cannot guarantee any wheelchair assistance or accessibility in international destinations. Sun & Fun Tours reserves the right to decline any trip participant whose condition, in our opinion, may affect the health, safety or enjoyment of other participants.

Sun & Fun Tour is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is Sun & Fun Tours responsible for the quality of medical care, or lack thereof, you may receive while on the trip.
